Sheridan found ABC and Touchstone Television have been unfairly dismissed from the series. According to Sheridan, he was fired for complaining about being hit in the head by show creator Marc Cherry during an argument on-set. She sued him, as well as ABC and Touchstone, but Cherry was dismissed from the lawsuit. Earlier this year the jury could not reach a decision in this case.

An appeals court said in August that the trial judge should give due Sheridan directed verdict was not technically fired, his contract just was not renewed. According to the California Labor Code, Sheridan case should be brought back under the term. That led to Sheridan requested rehearing, which was denied. He appealed to the state supreme court and that's what they are rejected here.

"The request was rejected," wrote Tani Cantil-Sakauye, the court chief justice. "Demand for the book ask depublication opinion is denied." No reason was given.

The next step is likely to return to the court of appeal.

No matter what happens here, anyone will ever touch it again with this mess? I certainly would not.
